Below is an overview of Workers’ Compensation benefits, although these claims are complex and there are many other statutory benefits and nuances to consider as your claim is advancing within the Workers’ Compensation system.

  • Temporary Total Disability (TTD): You may receive two-thirds of your wage loss for time when you are completely restricted from work, although TTD payments cap out at 130 weeks of TTD paid. The maximum TTD rate payable is currently 102% of the statewide average weekly wage, adjusted annually.
  • Temporary Partial Disability (TPD): You may receive two-thirds of your wage loss when you suffer a decrease in your earnings as a result of your work-related injury. TPD caps out at 225 weeks of TPD paid; however, new legislation increased the TPD benefit to 275 weeks for injuries occurring on or after October 1, 2018.
  • Permanent Partial Disability (PPD): You may receive PPD benefits if your doctor assigns a permanent disability rating for your injury, which is based on the Minnesota Disability Schedule and can be based on other factors, such as case law and determinations for ratings that fall outside of the Minnesota Disability Schedule.
  • Permanent Total Disability (PTD): You may receive PTD benefits at the same amount as your TTD benefits (to retirement, presumed at age 67, but this is rebuttable), which is the same as two-thirds of your average weekly wage. For PTD, there is a minimum rate of 65% statewide average weekly wage, adjusted annually.
  • Medical Treatment: The insurance company must pay all reasonable and necessary medical benefits for which the work injury is a substantial contributing factor. This includes injuries caused by a work incident, and injuries/conditions accelerate or aggravated by work duties. It can be medical care for specific injuries or (“Gillette”) injuries caused by repetitive stress and wear down trauma.
  • Vocational Rehabilitation: You may be eligible for vocational rehabilitation services from a Qualified Rehabilitation Consultant (QRC). The QRC assists in your return to suitable gainful employment with the employer, or obtaining other employment through employment counseling, skill development, and job search efforts. You may also be entitled to retraining to another vocation.
